Privacy

Your privacy is important to K&K Swiss AG, Via Sant' Abbondio 59, CH-6577 Ranzo (hereinafter: "we" or "us"). The protection of the data you provide to us and its security and confidential treatment are our highest principles. We would like to explain to you here to what extent and for what purposes personal data is collected and used in the context of the use of our online services and how we implement the protection of your data on our website.

1. Personal data

Personal data is individual information about personal or factual circumstances of an identified or identifiable natural person. This includes information such as your real name, address, telephone number and date of birth. According to the case law of the European Court of Justice, it can be assumed that the IP address also qualifies as personal data. This is a sequence of numbers that is usually assigned to you automatically on a regularly changing basis (dynamically) by your provider. This IP address is necessary to make an Internet-capable device addressable and thus usable for the Internet. Data is not personal if a person cannot be identified by it. For example, the number of visitors to our website or comparable summarized information does not allow any conclusions to be drawn about individual visitors. Apart from the following regulations, your personal data will not be passed on to third parties by us, unless this is necessary for the fulfillment of a legal obligation incumbent upon us. The extent and type of collection and use of your personal data differs depending on whether you visit our website merely to retrieve information or to make use of services offered by us.

2. Collection of usage data

When you visit our website, your browser automatically transmits various data that are necessary to enable you to visit our website. This data includes information about the operating system you are using, the browser you are using, the content retrieved, the time of your visit to our website, the website you visited before (so-called "referrer") and the amount of data transferred to you. This data is stored by our web server in the so-called log files. As a rule, it is not possible to establish a personal reference with this data. When you call up our website, your IP address, which may allow a conclusion to be drawn about your identity, is also transmitted to us. This data transmitted to us is also stored and processed in the log file for error analysis and statistical purposes. Personal user profiles are not formed. The above data is only evaluated for statistical purposes for the optimization of our online store.

3. Registration of a customer account, order processing

If you register with K&K Swiss AG, the following personal data will be collected:

- First name
- Last name
- E-mail address
- Password

The personal data provided by you during registration will be used by us to set up a customer account, i.e. collected, processed and used or passed on. The personal data will only be stored for the period in which you are registered with us.

To process the order, it is also necessary that you provide the following data:

- Company (opt)
- Billing and delivery address (street, house number, address addition (opt), zip code, city)
- Country
- Phone

This data is required for the processing of the purchase contract concluded between you and the seller on our platform.

We pass on your order data to the seller with whom you conclude a purchase contract on our platform. The latter will in turn pass on your data to external service providers (e.g. logistics companies, shipping companies) for the purpose of processing the contractual relationship. Your data will only be passed on for the aforementioned purpose and will not be processed outside the European Union.

If you have created a customer account, your data will be available for future purchases in our online store. Of course, a query about the stored data is made during each order process.

You can object to the further use of customer data at any time by e-mail, in writing or by telephone. Our contact details and further information on your right of objection can be found below under point 12.

In the event of your objection, your customer account will be deleted unless the data is still absolutely necessary for the processing of orders placed.

4. Order as a guest

If you place an order as a guest, i.e. without using a user account and or without prior registration, you must provide the following data:

- first name
- last name
- company (opt)
- billing and delivery address (street, house number, address suffix (opt), zip code, city)
- country
- e-mail address
- phone

The first and last name, as well as the billing and delivery address we or the seller processing your order. We use the e-mail address to send you an order confirmation and enables us to contact you if we have any queries about your order.

You can also voluntarily provide us with the company of the ordering company - if applicable - and a telephone number. The company name can be used as an address supplement or for the invoice, while the telephone number makes it easier for us to contact you if we have any questions about your order.

In order to process your order, we forward the data you provide to the seller of the product you have selected.

5. Payment processing

We do not collect and process your bank and payment data. Payment processing is carried out exclusively by the respective seller or a service provider commissioned by him, such as "Paypal".

6. Newsletter

In addition to the registration of a customer account and the processing of orders, we would like to send you interesting news and information about our company and our range of goods and services in the form of our newsletter - of course only if you explicitly consent to this at a separate point - occasionally by email based on your data.

In order to be able to register for our newsletter, we require, in addition to your separate data protection consent, your email address to which the newsletter is to be sent.

For the newsletter dispatch, we use the so-called double opt-in procedure, i.e. we will only send you the newsletter if you first confirm your registration via a confirmation email sent to you for this purpose by means of a link contained therein. In this way, we want to ensure that only you, as the owner of the email address provided, can subscribe to the newsletter. Your confirmation in this regard must be made within 48 hours of receipt of the confirmation email, otherwise your newsletter registration will be automatically deleted from our database.

You can give your consent to receive the newsletter separately when registering for our newsletter. You can revoke your consent at any time with effect for the future and thus unsubscribe from the newsletter. To do so, you can either send us an informal email to the email address below or use the "unsubscribe" link at the end of the newsletter to cancel. Our contact details as well as further information on your right of cancellation can be found below under point 9.

7. Cookies

We use so-called "cookies" on our website. These are small files that are stored on your PC. These allow us to store specific information related to you, the user, in connection with the use of our website. These cookies help us to determine the frequency of use and the number of users of our website, as well as to make our offers as convenient and efficient as possible for you.

The cookies we use can be distinguished as technically necessary and technically unnecessary cookies. Technically necessary cookies are those that are mandatory for the use of all functionalities of our website. Without these, an error-free use of our website cannot be guaranteed. Non-technically necessary cookies are, for example, those that allow us to make the website more user-friendly. In addition, these cookies help us to analyze user behavior with regard to our website.

Cookies have a certain lifespan, i.e. they remain stored on your computer for a certain period of time unless you delete them. The so-called "session cookies", are deleted immediately after closing the browser, while the so-called "permanent or persistent cookies" remain stored on your computer even after you have finished visiting our website and are not automatically deleted by closing the browser. The "permanent cookies" we use, however, delete themselves automatically after 2 years at the latest.

You can prevent the use of cookies that are not technically necessary by making the appropriate setting in your browser. You can find out more about this in the help option of the browser you are using.

8. Web analysis and advertising programs

The following web analytics and advertising services are used on our website en.kukko.com:

Google Analytics

Google Analytics is a web analytics service provided by Google, Inc ("Google"). Google Analytics uses cookies that are stored on your computer and that enable an analysis of your use of the website. These cookies used by Google Analytics can be both temporary and persistent cookies whose maximum lifespan usually does not exceed two years. The information generated by these cookies about your use of this website is usually transmitted to a Google server in the USA and stored there.

We have extended Google Analytics on this website with the program code "anonymizeIp" to ensure anonymized collection of IP addresses (so-called IP masking). Through IP anonymization, your IP address is shortened by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area before transmission to a Google server in the USA. Only in exceptional cases, over which we have no control, will the full IP address be transmitted to a Google server in the USA and shortened there.

Google will use this information on our behalf for the purpose of evaluating your use of the website, compiling reports on website activity and providing us with other services relating to website activity and internet usage. The IP address transmitted by your browser as part of Google Analytics will not be merged with other data from Google.

You can prevent the storage of cookies by selecting the appropriate settings on your browser software (see section 6). Please note that individual functions of our website may not work if you have deactivated the use of cookies.

You can prevent the collection of data generated by cookies and related to your use of the website (including your IP address) to Google, as well as the processing of this data by Google, by downloading and installing the browser plugin available at the following link tools.google.com/dlpage/gaoptout. Furthermore, it is possible to prevent the collection by Google Analytics by setting an opt-out cookie. To do so, please click on the following link: .

For more information on terms of use and data protection, please visit www.google.com/analytics/terms/de.html or https://www.google.de/intl/de/policies/.

Google Adwords

To draw the attention of potential users and customers to our website, we use the online advertising program Google AdWords from Google Inc. Google AdWords sets a cookie on your computer if you have accessed our website via a Google ad. These cookies lose their validity after 30 days and are not used for personal identification. If you visit our website and the cookie has not yet expired, we and Google can recognize that someone clicked on the ad and was thus redirected to our website. Each AdWords customer receives a different cookie. Cookies can therefore not be tracked across AdWords customers' websites. If you do not wish to participate in tracking, you can object to this use by preventing the installation of cookies by selecting the appropriate setting in your browser software (deactivation option). You will then not be included in the conversion tracking statistics. Further information as well as Google's privacy policy can be found at: www.google.com/policies/technologies/ads/, http://www.google.de/policies/privacy/

9. Social media

On K&K Swiss AG we link to our social media pages. The symbols implemented on our site for this purpose are designed as so-called hyperlinks. This means that when you click on a symbol, you will only be redirected to our page on the corresponding network. A transfer of your data does not take place.

10. Right of information and objection

With regard to the personal data we have collected about you, you have the right to be informed at any time as to whether and what data we have stored about you, what the purpose of this storage is, where this data originates, as well as whether and to whom this data is forwarded.

We make every effort to ensure that the personal data we store is factually correct and, if necessary, up to date. If we have nevertheless stored incorrect data relating to you, you may request us to correct this data.

Exceptionally, instead of correcting or deleting your data, we may block it if neither the correctness nor the incorrectness of the data can be established, or if deletion is precluded, for example, by statutory retention periods.

If the storage of your data is inadmissible or if your data is no longer required to fulfill a specific task, we will delete your data.

In individual cases, you may also object to the processing of your data if the processing is lawful. This is possible if, due to a special personal situation, you have an interest in data processing not taking place and this interest is to be classified as higher than our interest in data processing.

If you have a corresponding concern, please contact us using the contact details below.

11. Contact form

You can contact us directly via our website using the contact form. If you wish to use this contact form, it is necessary that you provide us with personal data - your name and e-mail address. The specification of your e-mail address is necessary in order to be able to contact you after processing your request. We use your name to be able to assign the inquiry to you and to address you personally when answering. It is not necessary to provide any other personal data. You also have the option of providing your telephone number so that we can contact you by telephone regarding your inquiry.

This data is stored and used exclusively for processing your request or for contacting you and the associated technical processes. Your data will be deleted after completion of the processing of your request, provided that you wish this and that the deletion does not conflict with any statutory retention obligations. Your data will not be passed on to third parties.
