Privacy Policy

K&K Swiss AG, located at Via Sant’Abbondio 59, CH-6577 Ranzo, Switzerland (hereinafter: “we” or “us”), cares about your privacy. Protecting the data you provide to us and keeping it safe and confidential are our highest principles. At this point, we would like to explain to what extent and for what purpose we collect and use personal data within the context of your use of our website and how we protect your data on our website.

1. Personal data

Personal data are individual details about personal or factual circumstances of a specific or identifiable natural person. This includes information such as your real name, your address, your telephone number and your date of birth. According to the case-law of the European Court of Justice, it can be assumed that the IP address also qualifies as a personal date. This is a sequence of numbers, which is usually assigned to you regularly in varying forms (dynamically) by your provider. This IP address is necessary to make an Internet-capable device addressable and thus usable for the Internet.

Data is not personal if it cannot be used to identify a person. For example, the number of visitors to our website or comparable summarized information does not allow any conclusions to be drawn about the individual visitors.

Apart from the provisions below, your personal data will not be passed on to third parties by us, unless this is necessary for the fulfillment of our legal obligation.

The extent and nature of the collection and use of your personal data differs depending on whether you visit our website only to retrieve information or to use services offered by us.


2. Usage data collection

When you visit our website, your browser automatically transmits various data necessary to enable you to visit our website. This data contains information about the operating system you are using, the browser you are using, the content retrieved, the time our website was accessed, the website you visited before accessing our website (called a “referer”) and the amount of data transmitted to you. This data is stored by our web server in log files. This data cannot be used to identify you.

When you visit our website, your IP address will also be sent to us; your IP address can be used to infer your identity.

These transmitted data are also stored in the log file and processed for error analysis and statistical purposes. Personal user profiles are not created using these data. The above-mentioned data are only evaluated for statistical purposes in order to optimize of our online shop.

3. Registration of a customer account, order processing

When you register an account with K&K Swiss AG, the following personal data will be collected:

– first name
– last name
– e-mail address
– password

The personal data provided by you as part of the registration will be processed by us to set up a customer account, i.e. the data will be collected, processed and used or shared. Your personal data are only stored for the period in which you are registered with us.

To process orders, you must also provide the following information:

– company name (optional)
– billing and delivery address (street, house number, second address line (optional), postal code, city)
– country
– telephone number

These data are required for the settlement of the purchase contract concluded between you and the seller on our platform.

Your order details will be forwarded to the seller you conclude a purchase agreement with on our platform. The seller in turn will forward your data to external service providers (e.g. logistics companies, freight forwarders) for the execution of the contractual relationship. Your data will only be forwarded for the aforementioned purpose and will not be processed outside the European Union.

If you have created a customer account, your data will be available for future purchases in our online shop. Each time you place an order, you will be prompted about the stored data as a matter of course.

You may object to the further use of your customer data at any time by e-mail, in writing or by telephone. Our contact details, as well as additional information about your right of objection, can be found in section 12 below.

If you object to having your data used, your customer account will be deleted unless the data is still required in connection with the processing of placed orders.

4. Guest orders

If you place an order as a guest, i.e. without using a user account and/or without prior registration, you must provide the following information:

– first name
– last name
– company name (optional)
– billing and delivery address (street, house number, second address line (optional), postal code, city)
– country
– e-mail address
– telephone number

Your first and last name, as well as your billing and delivery address, are required so that we or the seller can process your order. We will use your e-mail address to send you an order confirmation and to contact you if you have any questions about your order.

You may also voluntarily provide us with the name of the ordering company — if applicable — and a telephone number. The company name can serve as the address addendum (second address line) or for invoicing, and providing a telephone number makes it easier for us to contact you if we have questions regarding your order.

To process your order, we will forward the information you provide to the seller of the product you have selected.

5. Payment processing

We do not collect and process your banking and payment information. The payment is processed exclusively via the respective seller or by a service provider commissioned by the seller, such as “Paypal”.

6. Newsletters

Apart from the registration of a customer account and the processing of orders, we would also like to occasionally provide you with interesting news and information about our company and our range of goods and services in the form a newsletter sent to you by email using the information you have provided — of course, we will only do so with your express prior permission.

To sign up for our newsletter, we require your consent (provided separately) in accordance with data privacy law as well as the email address you wish to have the newsletter sent to.

We use a double opt-in procedure for sending out newsletters, i.e. we will not begin sending you the newsletter until you have confirmed your registration by clicking a link contained in a confirmation email sent to you for this purpose. We want to make sure that only you as the owner of the specified email address can sign up for the newsletter. Your confirmation must be made within 48 hours after receiving the confirmation email, otherwise your newsletter subscription will be automatically deleted from our database.

You can give your consent to receive the newsletter separately when registering for our newsletter. You can revoke your consent at any time with future effect and thus unsubscribe from the newsletter. You can either send us an informal e-mail to the e-mail address provided below or use the “unsubscribe” link at the bottom of the newsletter to cancel your subscription. Our contact details, as well as additional information about your right of withdrawal, can be found in Section 9 below.

7. Cookies

We use so-called “cookies” on our website. These are small files that are stored on your PC. These allow us to store specific information relating to you, the user, regarding your use of our website. These cookies help us to determine the frequency of use and the number of users of our website, as well as to make our product and service offerings as convenient and efficient as possible for you.

We distinguish between two types of cookies on our website: cookies which are strictly necessary and cookies which are not strictly necessary. Strictly necessary cookies are cookies that are absolutely required in order for you to use the full functionality of our website. Without these, we cannot guarantee that you will be able to use our website error-free. Not strictly necessary cookies are cookies that, for example, allow us to make our website more user-friendly. In addition, these cookies help us analyze the usage behavior on our website.

Cookies have a specified lifespan, which means that they stay on your computer for a certain amount of time unless you delete them. So-called “session cookies” are deleted immediately when you close your browser, while “permanent” or “persistent” cookies remain stored on your computer even after your visit to our website has ended, and they are not automatically deleted when the browser is closed. However, the permanent cookies we use delete themselves automatically after 2 years at the latest.

8. Web analytics and advertising programs

The following web analytics and advertising services are used on our website, www.kukko.de:

Google Analytics

Google Analytics is a web analytics service provided by Google Inc. (“Google”). Google Analytics uses cookies that are stored on your computer and that allow your use of our website to be analyzed. The cookies used by Google Analytics may be either temporary or persistent cookies, which typically have a maximum lifespan of two years. The information generated by these cookies about your use of this website is usually transmitted to a Google server in the United States and stored there.

We have added the program code “anonymizeIp” to Google Analytics on this website to ensure IP addresses are anonymized when collected (IP masking). IP anonymization results in your IP address being truncated by Google within Member States of the European Union or other parties to the Agreement on the European Economic Area prior to transmission to a Google server in the United States. Only in exceptional cases, over which we have no influence, will the full IP address be transferred to a Google server in the United States and truncated there.

Google will use this information on our behalf to evaluate your use of our website, to compile reports on website activities and to provide us with other services relating to website activity and internet usage. The IP address transmitted by your browser within the framework of Google Analytics will not be merged with other data by Google.

You can prevent the storage of cookies by setting your browser software accordingly (see section 6). Please note that some features of our website may not work if you disabled the use of cookies.

Google Adwords

To attract the attention of potential users and customers to our website, we use Google Inc.’s online advertising program Google AdWords. Google Adwords places a cookie on your computer when you are referred to our website by a Google ad. These cookies lose their validity after 30 days and are not used for personal identification. If, when you visit our website, the cookie has not yet expired, we and Google are able to recognize that someone clicked on the ad and was redirected to our website. Each advertiser receives a different cookie. Cookies cannot be tracked through the websites of advertisers. If you do not want to participate in the tracking of cookies, you can object to this by setting your browser software to prevent the installation of cookies (deactivation). You will not be included in the conversion tracking statistics. Algolia Search

Scope of the data processing
On our website we use a search engine service provided by Algolia Inc. (“Algolia”) for searching and indexing the content. Through the use of Algolia your IP address and your search inquiry will be transferred to an Algolia server and stored there for 90 days for statistical purposes. Please take note of Algolia’s Terms of Service (https://www.algolia.com/policies/terms) and its Privacy Policy (https://www.algolia.com/policies/privacy).

Algolia does not transfer the collected data to any third parties; it processes it exclusively internally for statistical evaluations and for the purpose of monitoring its services.

Legal basis for the data processing
The legal basis for the processing of the data is Article 6(1) point (f) GDPR.

Purpose of the processing
We use Algolia to make it easier for users to find the information on our website and thus make our site more user-friendly. Herein lies our legitimate interest in the meaning of Article 6(1) point (f) GDPR.

Personal data storage period
The data is stored in Algolia’s server for a period of 90 days.

9. Social media

On K&K Swiss AG we link to our social media pages. The icons on our site are designed to function as hyperlinks. This means that if you click on an icon you will be redirected to our page on the corresponding network, but your data will not be transmitted. 

10. Right to information and withdrawal

With regard to the personal data we collect about you, you have the right at any time to request information about whether and what data we have stored about you, what the purpose of this storage is, where this data came from, and if and to whom your data will be forwarded.

We make every effort to ensure that the personal data we store is factually correct and, if necessary, up-to-date. If we have nevertheless stored incorrect data about you, you can ask us to correct this data.

In exceptional cases, the rectification or deletion of your data may be blocked if neither the correctness nor the incorrectness of the data can be ascertained, or if, for example, deletion precludes statutory retention periods.

If the storage of your data is inadmissible or your data is no longer needed to fulfill a specific task, we will delete your data.

In individual cases , you may object to the processing of your data even if processing is lawful. This is possible if, due to a particular personal situation, you have an interest in the data processing being stopped and this interest takes precedence over our own interest in processing the data.

11. Contact form

You can contact us directly by using the contact form on our website. If you wish to use this contact form, you must provide us with personal information: your name and e-mail address. Your e-mail address is required to contact you after processing your request. We use your name in order to assign the request to you and to be able to address you personally when we respond to your request. The specification of further personal data is not required. You have the option to enter your telephone number as well so that we can also contact you by phone regarding your request.

This information is stored and used solely for the purpose of processing your request and contacting you, as well as for related technical processes. Your data will be deleted after the completion of the processing of your request, if you so desire and the deletion does not conflict with any statutory storage requirements. Your information will not be sent to third parties.
